In accordance with the Code of Conduct adopted by the City and County of Swansea, no interests were declared.

The Committee was requested to exclude the public from the meeting during the consideration of the items of business identified in the recommendations to the report on the grounds that it involved the likely disclosure of exempt information as set out in the exclusion paragraph of 12A of the Local Government Act 1972, as amended by the Local Government (Access to Information)(Variation)(Wales) Order 2007, relevant to the item of business as set out in the report.

The Committee considered the Public Interest Test in deciding to exclude the public from the meeting for the items of business where the Public Interest Test was relevant, as set out in the report.

Resolved that the public be excluded for the following items of business.

The Associate Lawyer reported that there had been a request for a further deferment of the matter.

The Operational Lead, Taxis, detailed the background details in respect of the request for deferment.

It was noted that since the original request for deferment on 14 April, 2023, GSL had been given every opportunity to instruct a legal representative and to attend via a variety of methods.

The Operational Lead, Taxis, assisted by the Team Leader, Licensing, presented the background information in respect of GSL. 

Members’ asked questions of the Officers who responded accordingly.

Resolved that:

1)    The request for a further deferment of the matter be refused.

2)    GSL’s request for a Restricted Hackney Carriage and Private Hire Driver’s Licence be refused.

Reasons for Decision

Members refused the request for the grant of the Restricted Hackney Carriage and Private Hire Driver’s Licence as they did not see any justifiable reasons to depart from the suitability guidance due to GSL having relevant convictions and therefore, deemed GSL not fit and proper to hold such a licence.
