The Licensing, Food & Safety Manager presented a report which detailed a review of suitability guidance for applicants and licensees of the Hackney Carriage and Private Hire Trades.

 

Members’ noted the purpose of the report, background, proposal and recommendations.

 

Members’ asked questions of the Officer who responded accordingly.

 

Resolved that:

 

1.     A consultation is undertaken with the members of the Hackney Carriage and Private Hire Trades and other interested parties on the proposal to adopt the ‘Guidance in determining the suitability of applicants and licencees in the Hackney Carriage and Private Hire trades; and

2.     A report detailing the outcome of the consultation is presented to Members for consideration.

Minutes:

The Committee was requested to exclude the public from the meeting during the consideration of the items of business identified in the recommendations to the report on the grounds that it involved the likely disclosure of exempt information as set out in the exclusion paragraph of 12A of the Local Government Act 1972, as amended by the Local Government (Access to Information)(Variation)(Wales) Order 2007, relevant to the item of business as set out in the report.

 

The Committee considered the Public Interest Test in deciding to exclude the public from the meeting for the items of business where the Public Interest Test was relevant, as set out in the report.

 

Resolved that the public be excluded for the following items of business.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Hackney Carriage and Private Hire Driver's Licence - AA.

Minutes:

The Licensing, Food & Safety Manager detailed the background in respect of AA.

 

AA explained the circumstances and answered Members’ questions.

 

Resolved that:

 

1.     AA’s private hire and hackney carriage drivers licences be suspended for 6 months

 

2.     No action be taken in respect of AA’s hackney carriage vehicle licence.

 

Reason for Decision

 

The Committee were not satisfied that AA was a Fit and Proper Person following his conviction on 11 December, 2018.
