Resolved that the undermentioned planning application Be Approved subject to the conditions in the report and/or indicated below(#):

 

#(Item 1) – Planning Application 2019/0911/S73 - Residential development incorporating public open space and new access roads from Gower View Road and Brynafon Road (outline) (Variation of conditions 1, 3 and 4 of planning permission 2005/2355 granted 23rd April 2010) to extend the time period for the submission of Reserved Matters on the remaining site area in accordance with the revised Design and Access Statement and Masterplan at Land West of Gower View Road And North of Brynafon Road, Penyrheol, Swansea

 

Graham Howells (objector) and Phil Baxter (agent) addressed the Committee.

 

Councillor J P Curtice (Local Member) addressed the committee and referred to her concerns about the need to maintain open space on the development and the retention of the recently refurbished play area, including the relocation of the zip wire.

 

A visual presentation was provided.

 

Report updated as follows:

 

The Council’s Ecologist has undertaken an assessment of the Likely Significant Effect of the proposed development on European Protected sites. The assessment concludes that there are no likely significant effects on the protected sites.

 

In order to ensure no significant impacts on the SSSI, condition 26 part viii) should be amended to read:

‘viii) all pollution prevention measures relating to nearby waterbodies particularly regarding the Carmarthen Bay and Estuaries SAC and Burry Inlet SPA, and the Burry Inlet and Loughor SSS (incorporating the mitigation and enhancement measures recommended in Section 2 of the Assessment of Potential Development Ecological Impacts and Mitigation Proposals Report prepared by Hawkeswood Ecology dated June 2019), and ‘

 

Application approved subject to a deed of Variation for the S106 agreement in accordance with the recommendation and subject to the amendment above to condition 26.

The Head of Planning & City Regeneration presented a report which outlined the request from the applicant (Enzo Homes) to modify the Unilateral Undertaking made pursuant to Section 106 of the Town and Country Planning Act 1990 (as amended) for the development at the former Civic Centre, Penllergaer.

 

The background details, consultation undertaken and the main issues arising from the request were outlined and detailed in the report.

 

Councillor E W Fitzgerald (Local Member) spoke in relation to the request and supported the officers recommendation of refusal.

 

Resolved that the request to modify the Unilateral Undertaking Deed of Variation (planning obligation) be refused.
