Minutes:

In accordance with the Code of Conduct adopted by the City and County of Swansea, no interests were declared.

Minutes:

The Committee was requested to exclude the public from the meeting during the consideration of the items of business identified in the recommendations to the report on the grounds that it involved the likely disclosure of exempt information as set out in the exclusion paragraph of 12A of the Local Government Act 1972, as amended by the Local Government (Access to Information)(Variation)(Wales) Order 2007, relevant to the item of business as set out in the report.

 

The Committee considered the Public Interest Test in deciding to exclude the public from the meeting for the items of business where the Public Interest Test was relevant, as set out in the report.

 

Resolved that the public be excluded for the following items of business.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Renewal of Hackney Carriage and Private Hire Driver's Licence - MBH.

Minutes:

The Operational Lead, Taxis, presented the background information in respect of MBH.

 

MBH explained the circumstances relating to the matter and answered Members’ questions.

 

Resolved that:

 

a)    MBH’s Hackney Carriage and Private Hire Driver’s Licence be renewed for one year.

b)    MBH be issued with a warning letter regarding future conduct.

c)     No further action be taken in respect of MBH’s Hackney Carriage and Private Hire Vehicle Licence.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Application for the Grant of a Hackney Carriage and Private Hire Driver's Licence - MSR.

Minutes:

The Operational Lead, Taxis, assisted by the Divisional Officer, Licensing and Food Safety, presented the background information in respect of MSR.

 

Members’ asked questions of the Officers who responded accordingly.

 

MSR, accompanied by Mr A, explained the circumstances relating to the matter and answered Members’ questions.

 

Resolved that:

 

1)    MSR’s application for the Grant of a Hackney Carriage and Private Hire Driver’s Licence be refused.

 

Reason for Decision

 

Members, after carefully considering the report presented to them, the character references previously provided, the additional character references provided at the hearing, the submissions made orally and the information provided by MSR’s  representative who additionally spoke on his behalf, decided that MSR’s application for the Grant of a Hackney Carriage and Private Hire Driver’s Licence be refused.

 

The reason for refusal was that Members did not consider MSR to be a safe and suitable or fit and proper person to hold a Hackney Carriage and Private Hire Driver’s Licence having considered the report presented to them and in relation to the  guidance, specifically points 3.16, 3.28, 3.29, 3.30, 4.12, 4.16, 4.20, 4.26, 4.30.
