The Associate Lawyer led a two minute silence in commemoration of former Committee Member, Councillor Hazel Morris.

Minutes:

In accordance with the Code of Conduct adopted by the City and County of Swansea, no interests were declared.

Minutes:

Resolved that the Minutes of the General Licensing Committee held on 9 December, 2022 be agreed as a correct record.

Minutes:

The Committee was requested to exclude the public from the meeting during the consideration of the items of business identified in the recommendations to the report on the grounds that it involved the likely disclosure of exempt information as set out in the exclusion paragraph of 12A of the Local Government Act 1972, as amended by the Local Government (Access to Information)(Variation)(Wales) Order 2007, relevant to the item of business as set out in the report.

 

The Committee considered the Public Interest Test in deciding to exclude the public from the meeting for the items of business where the Public Interest Test was relevant, as set out in the report.

 

Resolved that the public be excluded for the following items of business.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Application for the Grant of a Hackney Carriage and Private Hire Driver's Licence - MHJ.

Minutes:

The Operational Lead, Taxis, presented the background information in respect of MHJ. 

 

Members’ asked questions of the Officer who responded accordingly.

 

MHJ explained the circumstances relating to the matter and answered Members’ questions.

 

Following approval from the Associate Lawyer, the Democratic Services Officer circulated copies of character references in respect of MHJ.

 

Resolved that:

 

1)    MHJ’s application for the Grant of a Hackney Carriage and Private Hire Driver’s Licence be granted.

 

Reasons for Decision

 

The Committee were satisfied MHJ met the fitness criteria for grant. 

 

37.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Application for the Grant of a Hackney Carriage and Private Hire Driver's Licence - RWR.

Minutes:

The Operational Lead, Taxis, presented the background information in respect of RWR. 

 

RWR explained the circumstances relating to the matter and answered Members’ questions.

 

Resolved that:

 

1)              RWR’s application for the Grant of a Hackney Carriage and Private Hire Driver’s Licence be granted and RWR be issued with a warning letter regarding future conduct.

 

Reasons for Decision

 

Members of the General Licensing Committee after speaking with yourself and having considered the report presented to them decided they were satisfied you met the fitness criteria and approved your application for the grant for a hackney carriage & private hire driver’s licence. However Members wished to remind you that they take the safety of the public seriously and that as a professional driver licensed with the Authority, should you fail to comply with the bye-laws / conditions of licence and or should your conduct fall short of the standards expected of a licensed driver then you may be reported to the Committee for Members to decide whether you remain a fit and proper person to hold a licence.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Application for the Grant of a Restricted Hackney Carriage and Private Hire Driver's Licence - GSL.

Minutes:

The Chair advised that she had requested that an additional Officer attend, however, the Officer was not available.  Therefore, the Chair sought approval to defer the matter.

 

Resolved that the matter be deferred.
