Minutes:

In accordance with the Code of Conduct adopted by the City and County of Swansea, no interests were declared.

Minutes:

Resolved that the Minutes of the General Licensing Committee held on 8 July, 2022 be agreed as a correct record.

15.

Minutes:

The Committee was requested to exclude the public from the meeting during the consideration of the items of business identified in the recommendations to the report on the grounds that it involved the likely disclosure of exempt information as set out in the exclusion paragraph of 12A of the Local Government Act 1972, as amended by the Local Government (Access to Information)(Variation)(Wales) Order 2007, relevant to the item of business as set out in the report.

 

The Committee considered the Public Interest Test in deciding to exclude the public from the meeting for the items of business where the Public Interest Test was relevant, as set out in the report.

 

Resolved that the public be excluded for the following items of business.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Equality Act 2010 - Passengers in Wheelchairs - Request for an Exemption Certificate - AA.

Minutes:

The Operational Lead, Taxis, presented the background information in respect of AA.

 

AA explained the circumstances relating to the request and answered Members’ questions.

 

Resolved that:

 

a)    AA’s application for an indefinite exemption from carrying wheelchair users in Hackney Carriage and Private Hire Vehicles be refused.

 

Reason for Decision

 

The Committee were not satisfied given the comments AA gave for his exemption warranted an indefinite exemption.

 

17.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Application for the Grant of a Restricted Hackney Carriage and Private Hire Driver's Licence - ARY.

Minutes:

The Operational Lead, Taxis, presented the background information in respect of ARY. 

 

ARY, accompanied by Mr J, explained the circumstances relating to the matter and answered Members’ questions.

 

Resolved that:

 

1)    ARY’s application for the Grant of a Hackney Carriage and Private Hire Driver’s Licence be granted for one year.

 

Reasons for Decision

 

The Committee were satisfied ARY met the fitness criteria for grant, however in the absence of a certificate of good character the license should be granted for a period of one year.

 

 

18.

Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976 - Application for the Grant of a Hackney Carriage and Private Hire Driver's Licence - MSR.

Minutes:

The Operational Lead, Taxis, presented the background information in respect of MSR and referred to additional information which had been omitted from the report.  The Democratic Services Officer circulated the information to  Members.

 

MSR explained the circumstances relating to the matter and answered Members’ questions.

 

Resolved that:

 

1)    The decision on MSR’s application for the Grant of a Hackney Carriage and Private Hire Driver’s Licence be deferred.

 

Reason for Decision

 

The Committee considered all information within the report and listened to the applicants comments. Concern was expressed as MSR’s comments were inaudible inhibiting the taking of the note.  Therefore, the Committee offered MSR the opportunity to secure assistance; if he so wished prior to attending a future meeting.
